Terms of Service

1. Acceptance of terms

These Terms of Service (the "Terms") govern access to and use of the websites, mobile applications, platforms and services operated under the Mirrolabs brand (the "Services"). By accessing the Services, you accept these Terms in their entirety. If you do not agree, do not use the Services.

2. Who operates the Services

Mirrolabs is a commercial brand operated by Yonathan Avendaño, an independent developer with residence in Ibagué, Tolima, Colombia. Mirrolabs is not yet incorporated as a legal entity; legal responsibility for the Services rests with Yonathan Avendaño as an individual, under Colombian law.

3. Covered Services

These Terms apply to all Mirrolabs Services, present and future, including websites, mobile applications, SaaS platforms, connected hardware with software, and tools operated under the brand. When a specific Service requires particular conditions (e.g., subscriptions, payment plans, or hardware terms), we will publish them as addenda to these Terms.

4. User accounts

Some Services require creating an account. By doing so:

  • You are responsible for keeping your password confidential and for all activity under your account.
  • You must provide truthful, current and complete information.
  • You must notify us of any unauthorised use of your account at [email protected].
  • An account is personal and cannot be transferred without our written consent.

We reserve the right to suspend or cancel accounts that violate these Terms.

5. Acceptable use

By using the Services, you agree NOT to:

  • Reverse-engineer, decompile or attempt to access source code, except to the extent permitted by law.
  • Use the Services for illegal, fraudulent or rights-infringing activities.
  • Upload content that violates intellectual property rights, is defamatory, obscene, or promotes hate, violence or discrimination.
  • Interfere with the security, stability or availability of the Services (e.g., DDoS attacks, abusive scraping, malware distribution).
  • Use unauthorised bots or automated accounts.
  • Collect data from other users without their express consent.

Breach of this section may result in immediate account suspension and, where applicable, reporting to competent authorities.

6. Intellectual property

All intellectual property rights in the Services (including software, design, brand, editorial content, source code, databases) belong to Yonathan Avendaño and/or its licensors. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Services in accordance with these Terms.

Content you generate and upload to the Services remains yours. You grant us a worldwide, non-exclusive, royalty-free licence to store, process and display such content only to the extent necessary to provide you the Service.

7. Payments and subscriptions

Paid Services are governed by the specific conditions indicated at the time of contracting (price, periodicity, payment methods). Unless otherwise stated:

  • Payments are processed by third parties (Stripe, Wompi, PayU or others). We do not store credit card information.
  • Subscriptions renew automatically until you cancel from your account.
  • Refunds are governed by the Service's specific policy and by Colombian consumer protection legislation (Law 1480 of 2011).

8. Content and use of artificial intelligence

Some Services use AI systems to generate, transform or analyse content. You acknowledge and accept that:

  • AI-generated content may contain inaccuracies and must be verified by you before critical use.
  • AI outputs are subject to human supervision, but we do not guarantee complete accuracy.
  • You will not use the Services to generate illegal, harmful, misleading content or content that infringes third-party rights.
  • When a Service operates wholly or partly via connection to third-party AI models, its availability may be affected by the policies or availability of those providers.

9. Warranties and limitation of liability

The Services are provided "AS IS" and "AS AVAILABLE". To the maximum extent permitted by law, we do not warrant that the Services will be uninterrupted, error-free, or that they will meet specific expectations not agreed in writing.

In no event will Yonathan Avendaño, its affiliates or providers be liable for indirect, incidental, consequential damages, lost profits or data loss arising from use of the Services, except where such limitation is prohibited by applicable law. Nothing in these Terms excludes or limits liability for wilful misconduct or gross negligence.

10. Indemnification

You agree to hold Yonathan Avendaño harmless against any claim, damage or expense (including reasonable legal fees) arising from your improper use of the Services, your violation of these Terms, or your infringement of third-party rights.

11. Termination

You may terminate your use of the Services at any time by deleting your account. We may suspend or terminate your access if you breach these Terms or if we discontinue a Service. Termination does not affect payment obligations already accrued nor clauses that by their nature must survive (intellectual property, limitation of liability, indemnification, governing law).

12. Modifications

We may modify these Terms. Material changes will be notified at least fifteen (15) days in advance by email or prominent notice in the Services. Continued use of the Services after they take effect constitutes acceptance of the new version.

13. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Colombia. Any dispute arising from these Terms or use of the Services will be submitted to the competent courts of the city of Ibagué, Tolima, Colombia, except where applicable law establishes a different non-waivable consumer forum.

14. General provisions

If any provision of these Terms is invalid or unenforceable, the remaining provisions will remain in full force. Failure to exercise a right does not constitute waiver of it. These Terms, together with the Privacy Policy and any Service-specific conditions, constitute the entire agreement between the parties.
